Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Milesgator ("ThemeHarvest", "we", "us"), 1/5505 Balbir nagar extension shahdara delhi-32, for the use of https://themeharvest.com and its services. By creating an account, buying, selling or otherwise using the site you accept these Terms, our Privacy policy and the policies linked below. If you do not agree, please do not use the site.

1. Definitions

Marketplace — the website https://themeharvest.com, its apps and APIs.
Author — a user who offers items for sale. Buyer — a user who buys or downloads items.
Item — a digital product listed on the marketplace (theme, template, script, plugin, code, graphics, etc.), including its updates.
License — the right to use an item, as described on the Licenses page.

2. Our role

ThemeHarvest is an online marketplace (an "intermediary" and "marketplace e-commerce entity" under Indian law). Items are created, owned and sold by independent authors; we host the listing, review it, take payment on the author's behalf, deliver the files and pay the author. The author's name and profile are shown on every item page and on your invoice. Unless an item is sold by Milesgator itself, the author is responsible for the item and its description.

3. Eligibility and accounts

You must be at least 18 years old, or use the site under the supervision of a parent or guardian who accepts these Terms.
Give accurate information, keep it up to date, and keep your password (and two-factor codes) secret. You are responsible for all activity on your account.
You may sign in with Google, Facebook, GitHub or LinkedIn where offered. Your use of those services is governed by their own terms.
One person or business may not open multiple accounts to get around limits, reviews, refund rules or bans.

4. Buying items

When you buy an item you receive a non-exclusive, non-transferable license to use it as described on the Licenses page. You do not acquire ownership of the item or its copyright.
Prices are shown in the site currency and, for convenience, in your local currency. The amount you pay is the one shown at checkout, including any taxes and fees listed there (see Payments, fees & taxes).
On your first purchase we ask for billing details (name, address, country) for your invoice and for tax purposes. They must be correct.
Delivery is digital and immediate after a confirmed payment (see the Delivery policy).
Supported items include author support for the period shown on the item page, under the Item support policy.

5. Selling items

Authors must hold all rights to what they upload, follow the Item upload guidelines and accept the Author agreement, which forms part of these Terms. We may refuse, remove or disable any item at our discretion, in particular for legal, quality or security reasons.

6. Payments, wallet and refunds

Payments are processed by licensed payment partners. We never see or store your full card number.
Your site wallet holds refunds, top-ups and (for authors and affiliates) earnings. Wallet balances have no interest and cannot be transferred to other users.
Refunds are handled under our Refund & cancellation policy. Chargebacks raised without first contacting us may lead to the purchase license being suspended while the dispute is open.

7. Other services

Where available: subscriptions give access to a library of items for the paid period and renew until cancelled; custom work (hire) is an agreement between the buyer and the author, with payment held by us until delivery is accepted or a dispute is decided; contests follow the rules shown on each contest page; the affiliate program follows the Affiliate program terms.

8. Your content

Reviews, comments, forum posts, support messages and other content you post must be honest, lawful and respectful. You keep ownership of your content and give us a worldwide, royalty-free license to host, display and moderate it on the marketplace. We may hide or remove content that breaks these Terms or our Acceptable use policy. Reviews must be about your real experience with the item; paid, fake or swapped reviews are not allowed.

9. Acceptable use

You must follow our Acceptable use policy. In particular you may not upload or share content that is unlawful, infringes anyone's rights, contains malware, or harms minors; and you may not resell or share purchased files outside your license.

10. Intellectual property

The ThemeHarvest name, logo and site design belong to Milesgator. Items belong to their authors. If you believe content infringes your rights, use our copyright complaint form — see the Copyright policy.

11. Disclaimers

Items are provided by their authors "as is". We review items but cannot guarantee that every item is error-free, uninterrupted or fit for your particular purpose. See the Disclaimer. Nothing in these Terms excludes rights you have under consumer protection law that cannot be excluded.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential losses (such as lost profits, data or business), and our total liability for any claim relating to an item is limited to the amount you paid for that item in the 12 months before the claim.

13. Indemnity

You agree to compensate us for losses and reasonable costs caused by your breach of these Terms, your content, or (for authors) a claim that your item infringes someone else's rights.

14. Suspension and termination

You may close your account at any time from Account → Settings or by writing to us. We may suspend or close accounts that break these Terms, commit fraud, abuse refunds or harm other users, after notice where reasonable. Licenses for items you paid for continue unless they were obtained by fraud or a chargeback.

15. Changes

We may update these Terms to reflect new features or legal requirements. Material changes are announced on the site or by email before they take effect; using the site afterwards means you accept the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of India. Please contact us first — most problems are solved quickly. Unresolved disputes are subject to the exclusive jurisdiction of the courts at the city of our registered office, without affecting any mandatory consumer rights you have in your country of residence. Complaints can also be raised with our Grievance officer.
