Author Agreement

Last updated: 23 October 2026

This agreement is between you (the "Author") and Milesgator ("we") and applies to every item you offer on ThemeHarvest. It is part of our Terms of Service.

1. Your items and rights

  • You confirm that you created each item or hold licenses that allow you to sell it, including all bundled images, fonts, icons, libraries and code, and that it does not infringe anyone's rights.
  • You keep the copyright. You grant buyers the licenses described on the Licenses page, and grant us a worldwide, non-exclusive right to host, review, display, demonstrate, promote and distribute the item and its previews on the marketplace and in our marketing.
  • Items must work as described, follow the Item upload guidelines, be free of malware and come with documentation. We may reject, edit listing details for accuracy, or remove items at our discretion.

2. Exclusive and non-exclusive authors

Exclusive authors sell their items only on ThemeHarvest and pay a lower fee that decreases as their lifetime earnings grow (tiers are shown in Studio). Non-exclusive authors may sell elsewhere and pay a platform fee of 45% of the net sale.

3. Earnings, fees and payouts

  • For each sale you earn the net item price minus our platform fee. Taxes collected from buyers, payment/handling fees and affiliate commissions are not taken from your share.
  • Earnings are credited to your balance after each sale. New earnings may be subject to a short clearance period before they can be withdrawn; any such period is shown in Studio → Withdrawals.
  • You can withdraw once your available balance reaches $50.00, to a bank account, UPI, PayPal or international bank (SWIFT/IBAN) as offered in Studio → Withdrawals.
  • Identity and tax verification (KYC) may be required before withdrawals. Payout details must belong to you or your business.
  • Refunds, chargebacks and fraudulent sales are deducted from your balance; the balance can become negative and is recovered from future earnings.

4. Taxes

You are responsible for your own income tax and, if registered, GST on your earnings. Where Indian law requires, we deduct tax at source on e-commerce sales (section 194-O of the Income-tax Act, 1961, or the corresponding provision of the Income-tax Act, 2025) from the gross amount of your sales (at the rate in force at the time of the sale) and issue TDS certificates. International authors are responsible for taxes in their country.

5. Support and updates

If you mark an item as supported, answer buyers within 2 working days during the support period under the Item support policy. Keep items compatible with current versions where reasonable and fix security problems promptly. Buyers receive updates free of charge.

6. Conduct

Follow the Acceptable use policy. Do not manipulate reviews or sales, ask buyers to pay outside the platform, or use buyers' data for anything other than supporting them.

7. Ending the agreement

You can stop selling at any time by disabling your items; buyers keep their licenses and downloads. We may close author accounts for fraud, infringement or serious breaches. Earnings not affected by a breach are paid out after the clearance period and any open refunds or disputes are settled.
